Отказ в выплате страхового возмещения: отдельные практические проблемы

Abstract

Статья посвящена отдельным практическим проблемам страхового возмещения в связи со значительным числом судебных споров, поскольку на современном этапе отсутствует единообразная судебная практика по данному вопросу. Автором проведена работа по определению проблем, возникающих вследствие неоднозначности применения норм страхового законодательства, регулирующего вопросы отказа в страховой выплате, сделан вывод о важности стабильности рынка финансовых услуг. Наличие различных подходов к проблемам отказа в страховой выплате является серьезной угрозой устойчивости рынка страхования.

The article is devoted to the practical problems of individual insurance compensation in connection with a considerable number of legal disputes, as at present there is no uniform jurisprudence on the matter. The author of the work is carried out to identify the problems arising from the ambiguity of the application of the insurance legislation on the refusal of the insurance compensation, the importance of the stability of the financial services market is concluded. The existence of different approaches to the problems of refusal of insurance payment is a serious threat to the stability of the insurance market.
