| Abstract: | Автор на основе трактата, изданного Робертом Снеггом, и записей одного из студентов реконструирует содержание лекций юриста, прочитанных в 1581 г. и посвященных статье 29 Великой хартии вольностей Генриха III (1225). Юрист считал, что разрушенное нормандским завоеванием древнее совершенное английское право, определяющее границы королевской власти, было восстановлено дарованной Генрихом III хартией. Однако студент не зафиксировал эти принципиальные моменты, оставив записи разбираемых казусов и передачи земельных держаний. Это говорит о том, что в 1580-х гг. хартия и ее 29 ст. носили рамочный характер и не имели того радикального смысла, который обретут в 1630-е гг. The article describes the reading of the lawyer Robert Snagg, delivered in 1581 and devoted to chapter 29 of the Magna Carta of Henry III (1225). The content of reading is reconstructed on the basis of the treatise published later by the lawyer and records of one of students. It shows that the lawyer believed that the ancient perfect English law, defining the limits of Royal power, had been destroyed by the Norman Conquest and restored by the Magna Carta granted by Henry III. But the student had non fixed these fundamental moments, leaving records with the analyzed cases and records of transfer of land possessions. This says that in the 1580s the Magna Carta and its chapter 29 were of a framework nature and did not have the radical meaning that they would acquire in the 1630s. |
