Проблемы дискриминации и неравенства в правовой системе России

Abstract

Настоящая статья представляет собой анализ российской судебной практики, касающейся общепризнанных стандартов в области обеспечения прав человека – равенства и недискриминации. Автор рассматривает следующие вопросы: закрепление принципа; появление признаков дискриминации в актах судебной власти; допустимые пределы ограничения прав; инициаторы подачи жалобы и заявлений о дискриминации; результаты рассмотрения судами вопросов о дискриминации; выявление дискриминационных позиций в нормативных правовых актах; установление фактов дискриминации в юридической практике.

The present article is the analysis of the Russian judicial practice, concerning the universally recognized standards in the guarantee of human rights – equality and non-discrimination. The author examines the following questions: the enshrinement of principle; the development of the signs of discrimination in the acts of judicial authority; the permissible limits of the limitations of rights; the initiators of filing a complaint and statements about the discrimination; the results of examination by the courts of questions about the discrimination; the revealing of discriminatory positions in the normative legal acts; the establishment of the facts of discrimination in the legal practice.
