Концептуальная модель применения цифровых технологий в законодательном процессе в Российской Федерации : монография

Abstract

Монография представляет собой междисциплинарное исследование трансформации законодательного процесса в условиях имплементации цифровых технологий. Цифровизация законодательного процесса выступает неотъемлемой составляющей развития современного государства, что предопределяет необходимость формирования концептуальной научно-обоснованной модели внедрения цифровых технология в процесс разработки и принятия нормативных правовых актов. Разработка такой концептуальной модели применения современных цифровых технологий в законодательном процессе с учетом достижений зарубежной практики и особенностей российской системы законодательного процесса выступает необходимым этапом последовательного развития правотворческой деятельности в России. В этой связи в работе разработана комплексная эволюционная модель теоретико-правовой трансформации процесса разработки и принятия нормативных правовых актов, обеспечивающая сохранение конституционно-правовой сущности данной сферы осуществления публичной власти. Коллектив авторов с учетом выявленного доктринального базиса обосновал ряд организационно-правовых моделей внедрения цифровых технологий на современном этапе развития законодательной деятельности в Российской Федерации. Такой подход позволил сформировать интегративную модель применения цифровых технологий в законодательной деятельности, которая в состоянии обеспечить качественную трансформацию этой сферы в условиях становления современного цифрового государства в России.

The monograph is an interdisciplinary study of the transformation of the legislative process in the context of the implementation of digital technologies. Digitalization of the legislative process is an integral component of the development of the modern state, which determines the need to form a conceptual, scientifically based model for the introduction of digital technologies into the process of developing and adopting regulatory legal acts. The development of such a conceptual model for the use of modern digital technologies in the legislative process, taking into account the achievements of foreign practice and the specifics of the Russian legislative process system, is a necessary stage in the consistent development of law-making activities in Russia. In this regard, the work has developed a comprehensive evolutionary model of the theoretical and legal transformation of the process of drafting and adopting normative legal acts, ensuring the preservation of the constitutional and legal essence of this sphere of public authority. Taking into account the revealed doctrinal basis, the team of authors has substantiated a number of organizational and legal models for the introduction of digital technologies at the current stage of legislative development in the Russian Federation. This approach has made it possible to form an integrative model of the use of digital technologies in legislative activity, which is able to ensure a qualitative transformation of this sphere in the context of the formation of a modern digital state in Russia.
