Юридическая ответственность учащихся в сфере образовательных отношений

Abstract

В статье исследуется юридическая ответственность учащихся в рамках образовательных отношений, рассмотрены меры дисциплинарной ответственности и меры педагогического воздействия. Автор приходит к выводу, что меры педагогического воздействия требуют дополнительного правового регулирования в рамках Федерального закона «Об образовании в Российской Федерации», а также в рамках локальных нормативных актов образовательных организаций, поскольку меры дисциплинарной ответственности или не достигают своих целей (замечание, выговор учащемуся) или носят исключительный характер (отчисление). При создании правовых механизмов применения мер педагогического воздействия автор предлагает использовать принцип воспитания естественными и логическими последствиями, предложенный Ж-Ж Руссо, что отвечает идее гуманизма. Автор полагает, что создание правовых рамок для выполнения учащимися своих обязанностей положительно скажется на качестве образования и на развитии интеллектуального потенциала учащихся.

The article examines the legal responsibility of school students in the framework of educational relations, considers measures of disciplinary responsibility and measures of pedagogical influence. The author comes to the conclusion that measures of pedagogical influence require additional legal regulation within the framework of the Federal Law "On Education in the Russian Federation", as well as within the framework of local regulations of educational organizations, since disciplinary measures do not achieve their goals or are applied in exceptional cases. The author proposes to use the principle of natural and logical consequences when creating legal mechanisms for the application of measures of pedagogical influence. The principle of natural consequences was proposed by J.-J. Rousseau and corresponds to the idea of humanism. The author believes that the creation of a legal framework for school students to fulfill their duties will have a positive impact on the quality of education and on the development of the intellectual potential of school students.
