Совершенствование механизма защиты прав детей в Республике Казахстан

Abstract

The issue of ensuring human rights, including those of the most vulnerable segments of the population, namely the rights of children and the child, has become particularly relevant in recent years. Practice has shown that the twentieth century has given countless examples of gross violation and violation of almost the entire list of human rights and freedoms enshrined in international documents, not to mention national legislation. Despite numerous regulations, this problem is not solved today. The socio-economic situation in the country dictates the urgent need to develop a scientifically sound set of measures that create an effective system of measures for the realization of children’s rights. The relevance of this article is that the realities of time require the formation of an effective Kazakh system of protection of the rights and interests of children. Therefore, the choice of theme is caused by necessity of legal studies of the problems of children’s rights and protection in the Republic of Kazakhstan, analysis of their legal status, establishing the role and components of procedures for the protection of children’s rights as a mechanism for strengthening its legal status. To achieve these goals, the authors set the task: to analyze the legal consolidation of the rights of children and their protection in the modern Kazakh administrative legislation, as well as to develop proposals to improve the national legislation governing the rights of children and their protection in the Republic of Kazakhstan. Вопрос обеспечения прав человека, в их числе наиболее беззащитных слоев населения, а именно прав детей и ребенка, в последние годы стал особенно актуальным. Практика показала, что ХХ век дал бесчисленное множество примеров грубейшего попрания и нарушения практически всего перечня прав и свобод личности, закрепленного в международных документах, не говоря уже о национальном законодательстве. Несмотря на многочисленные нормативно-правовые акты, эта проблема не решена и сегодня. Социально-экономическая ситуация в стране диктует острую необходимость разработки научно обоснованного комплекса мер, создающих эффективную систему мер для реализации прав детей. Актуальность данной статьи заключается в том, что реалии времени требуют формирования эффективной казахстанской системы охраны прав и защиты интересов детей. Следовательно, выбор темы обусловлен необходимостью правового исследования проблем прав детей и их защиты в Республике Казахстан, анализа их правового закрепления, установления роли и составных элементов процедуры защиты прав детей как механизма упрочения его правового статуса. Для достижения данных целей авторами поставлена задача: проанализировать правовое закрепление прав детей и их защиты в современном казахстанском административном законодательстве, а также разработать предложения по совершенствованию национального законодательства, регламентирующего права детей и их защиты в Республике Казахстан. В статье использованы общенаучные методы системного анализа и обобщения нормативных, научных и практических материалов. Сформулированные в работе теоретические положения и выводы развивают и дополняют ряд разделов теории конституционного и административного права в сфере определения и правового закрепления прав детей.
