Конституционно-правовая реформа в современной России: цели, ценности, риски

Abstract

The article considers the realization of the development potential of society and the state in the process of the latest reform of the Constitution of the Russian Federation, describes the features of determining the goal of constitutional reform, its legal and substantive aspects, the problems of the hierarchy of its goals, the ratio of goal and result, the objective conditionality of the goal by the qualitative state of society systems, as well as the international situation, analyzes the relationship of the goals of constitutional reform with strategic planning documents, the tasks of forming a just society and prosperity of Russia, the problems of conformity of the result of the constitutional reform with the fundamental values of society are investigated, the value system of the constitutional reform is considered, the features of the formal consolidation of the latest amendments to the Constitution of the Russian Federation, issues related to the possibility of radically changing the content of the Constitution of the Russian Federation through amendments, finding the limit of such a change, the problems of choosing between amendments and revision of the Constitution of the Russian Federation, ensuring the authority and stability of the Constitution of the Russian Federation, its ability to effectively influence public relations, as well as serve as a foundation for the development of the Russian legal system, the problems of the correlation of values inherent in our society and the reception of other values, ensuring the balance of values of the individual, society and the state, the risks arising in the process of implementing and implementing the latest amendments to the Constitution of the Russian Federation are characterized.

В статье рассматриваются реализация потенциала развития общества и государства в процессе новейшего реформирования Конституции РФ, характеризуются особенности определения цели конституционной реформы, ее правовые и содержательные аспекты, проблемы иерархии ее целей, соотношение цели и результата, объективная обусловленность цели качественным состоянием систем общества, а также международной обстановкой, анализируется взаимосвязь целей конституционной реформы с документами стратегического планирования, задачами формирования справедливого общества и процветания России, исследуются проблемы соответствия результата конституционной реформы основополагающим ценностям общества, рассматривается система ценностей конституционной реформы, особенности формального закрепления новейших изменений Конституции РФ, вопросы, связанные с возможностью кардинального изменения содержания Конституции РФ посредством поправок, нахождения предела такого изменения, проблемы выбора между поправками и пересмотром Конституции РФ, обеспечения авторитета и стабильности Конституции РФ, ее способности эффективно воздействовать на общественные отношения, а также служить фундаментом для развития системы права России, характеризуются проблемы соотношения ценностей, свойственных нашему обществу и, рецепцией иных ценностей, обеспечения баланса ценностей личности, общества и государства, риски, возникающие в процессе осуществления и реализации новейших изменений Конституции РФ.
